The Supreme Court gave President Donald Trump an important immigration victory on Thursday, clearing the path for the deportation to South Sudan of eight migrants who were originally ordered to be removed from Djibouti.
In a brief, unsigned opinion the justices granted to the administration the request to “clarify a previous ruling”, confirming that the stay they issued on June 23 of an injunction from a lower court also blocked the follow-up remedy order issued on May 21.
The government was required to notify the migrants and give them the opportunity to file a claim under the Convention Against Torture prior to their being sent to a tertiary country.
The court stated that “the motion for clarification has been granted”. The court wrote: “The May 21, remedial order can no longer be used to enforce a injunction which our stay rendered unenforceable.”
Elena Kagan, a liberal justice on the court, also took a conservative view.
Justice Elena Kagan supported the decision. She is a liberal member of the Supreme Court. She wrote a short concurring opinion stating that she disagreed with Supreme Court’s initial decision to allow removals from third countries to continue.
She wrote: “But the majority of this court did not agree with me, and I cannot see how a district judge can enforce a stay that this court issued.”
Attorney General Pamela Bondi announced the decision on social media in a Thursday afternoon post.
Bondi, on X said that “yet another rogue District Judge has been rebuked” by the Supreme Court due to the dedicated work of DOJ attorneys. She added that Donald Trump will “continue to exercise his full power to remove killers as well as violent criminal illegal immigrants from our country.”
Trump’s winning streak is still going strong.
