On Friday, a Federal Appeals Court ruled that Donald Trump’s tariffs were illegal.
The Trump administration has time to appeal the decision to the Supreme Court before it becomes effective on October 14.
The federal appeals court ruled on Friday that President Donald Trump could not use emergency powers granted to him by Congress to impose duties, potentially forcing the administration to pay back billions of dollars in tariffs.
The 7-4 ruling casts doubt on the deals Trump made with the European Union (EU), Japan, South Korea, and other major trading partners, to reduce “reciprocal tariff rates” on their imports from the levels set by the administration in April.
The majority concluded that “Congress… did give the President wide-ranging powers to impose tariffs”, of the type Trump imposed through his executive orders.

The Trump administration has until October 14 to appeal to the Supreme Court the decision.
Donald Trump’s response to the ruling was that “ALL TARIFFS ARE STILL EFFECTIVE” and that “Highly Partisan Appeals Court Incorrectly Said That Our Tariffs Should Be Removed.”
He added: “For many, many years, our careless and unwise politicians allowed Tariffs to be used against them.” With the United States Supreme Court’s help, we will now use them for the benefit of our nation and make America rich, strong, and powerful again!
ALL TARIFFS ARE STILL EFFECTIVE! A highly partisan Appeals Court today incorrectly stated that our Tariffs were to be removed. However, they know in the end the United States of America would win. It would be a disaster for our Country if these Tariffs were ever removed. We would become weak financially, and we need to be strong. The U.S.A. won’t tolerate huge Trade Deficits, unfair Tariffs, and Non-Tariff Trade Barriers that are imposed by countries, whether they be friends or enemies, which undermine our Farmers, Manufacturers, and anyone else. We should remember, as we begin this Labor Day Weekend, that TARIFFS can be the most effective tool for helping our Workers and supporting companies that make great MADE-IN-AMERICA products. Our uncaring, unwise politicians have used Tariffs against us for many years.
