Special counsel Jack Smith has filed a new legal brief—which includes redacted names of dozens of people—alleging that Donald Trump “resorted to crimes” in his attempts to overturn the 2020 election results.
The 165-page document was unsealed by U.S. District Judge Tanya Chutkan on Wednesday. The document argues why the federal 2020 election interference case should continue in the wake of the Supreme Court‘s ruling granting Trump at least presumptive immunity from prosecution for officials acts carried in office. Prosecutors in the document have focused on Trump’s actions as a private citizen and candidate, not as the president.
While dozens of names are redacted, many of them are easily identifiable by the job titles or public comments cited in the brief.

These include five of six alleged coconspirators who were included in the original federal indictment against Trump, but not charged with any crime: Trump lawyers Rudy Giuliani, Kenneth Chesebro, John Eastman and Sidney Powell, as well as adviser Boris Epshteyn.
Former White House chief strategist Steve Bannon is also listed as P1 in the brief. Bannon can be identified in the document, for instance through comments he made just days before the 2020 election that Trump will “just declare victory” regardless of the results.
Newsweek has contacted the offices, representations or legal teams of Bannon, Giuliani, Chesebro, Epshteyn, Meadows, Powell, Kemp for comment via email or online form.
There are a further 76 redacted names, who are only identified as P2, P3, all the way up to P77.
Former White House chief of staff Mark Meadows (P21) and Georgia Governor Brian Kemp (P17) are among those who have their names redacted in Smith’s immunity brief, but their jobs and positions are still viewable.
In further filings, Smith’s team said proposed redaction of the names only is “sufficient to protect witnesses from harassment while permitting an appropriate degree of public access.”
Trump, who has pleaded not guilty to four federal charges, accused Smith of submitting a “falsehood-ridden, unconstitutional” filing submitted in response to Minnesota Governor Tim Walz‘s “disastrous” vice presidential debate performance.
