Joe Biden claimed executive privilege in May 2024 to prevent the publication of his interview with Robert Hul.
A transcript shows that Biden’s memory was poor and he had mental lapses at least five times during the interview.

On Thursday, President Joe Biden invoked executive privilege over his interview conducted with Robert Hur, special counsel. This was to prevent Congress from being able to obtain the audio recordings.
The House Oversight Committee has scheduled a Thursday markup to begin the process to hold Attorney General Merrick G. Garland in contempt for refusing to turn over the recording.

According to Breitbart News, Biden’s 81-year-old mental lapses, and “poor memories” were evident at least seven different times during the President’s interview with Hur.
The Associate Attorney General Carlos Uriarte sent a letter to House Judiciary and Oversight Committee Chairs Jim Jordan (R – OH) and James Comer(R – KY), informing them that President Obama had asserted executive privilige over the audio recordings requested and that he was making a protective claim of privilege for any materials that are responsive to subpoenas but have not yet been produced.
According to reports, the Trump administration has plans to release these tapes.
According to top Trump officials who briefed two Republicans, the Trump administration plans to release audio of the former president Joe Biden’s interview with Robert Hur. Hur was the special counsel that investigated Biden’s handling of classified papers and raised concerns about his mental acuity.
Details of the plan remain unclear and it’s not clear if President Donald Trump or his advisors have decided to release the audio.
Biden’s team is getting ready for a possible release. Two people who are familiar with Biden’s preparations, but spoke anonymously to protect their identities, confirmed this.
On May 20, a deadline of sorts will be approaching: in separate Freedom of Information Act suits brought by conservative organizations like Judicial Watch, Heritage Foundation and other news organizations, a judge has ordered the Justice Department to decide whether it will support Biden’s assertion of Executive Privilege to block the release of these tapes. In May last year, Biden’s Justice Department and he claimed that releasing the tapes could have a chilling impact on witnesses cooperating with high-profile investigations.
